In The Name of God Amen the seventh day of
August in year of our Lord One thousand seven hundred and one. I James
Pemberton of the parish of St. John and island
abovesaid, being sick in body but of sound mind, and memory, Do make
& declare this my last will and testament in manner following:
First and principally I bequeath my Soule to Almighty God that gave it,
and my body to the earth therein to be decently interred according to
the discretion of my executors hereafter named; and my temporall estate
as followeth;
that is to say I give devise and bequeath all that my personall and
reall estate Situate in the parish of St.
George and Island aforesaid to my Loving son John Pemberton and the
heires of his body Lawfully begotten for ever together with thirty and
one Negro slaves by names Hector, Dick, Doll, Dicky, Barbara, John,
Jumba, Minga, Little John, Will, Munday, Tonsaw, Qwashea, Meme, Kate,
Sue, Iram, Sarah, Cumbo, Ada, Marya, little Marya, old Doll Mary,
Violett, Jeppa, Betty, women, Jack, Kitty, Cully, Robin, boys, Nancy,
Joan, Bessie, Marya, Girles, with their issue and increase. But if it
should happen that my said son John should depart this life before he
attains to the full age of One and Twenty years, without any lawfull
issue of his body begotten then it is my will and pleasure that the one
half of my said land and negroes be and remain to James Pemberton son of
my eldest son James, and to the heires of his body lawfully begotten for
ever, And the other mouty[?] or one half of the said estate to my
Surviving Sons and the heires of their bodyes lawfully begotten for ever
to hold in common and undivided; And if either of my said surviving
children should depart this life before he attains to the age of One and
Twenty years without lawfull issue, that then his share in my said
estate to be and remains to the rest of my surviving children and to
their heires for ever to be held in common as aforesaid And if my said
Grandson James Pemberton should happen to dye before he attains the age
of One and Twenty years without lawfull issue then it is my will that
his proportion of my said estate shall descend and come to my said
surviving children and to be held in Common as to above mentioned, Item
I give & bequeath unto my two sons Peter and Joseph the sum of Five
hundred pounds Sterling each of them to be paid them out of my said
estate in the said parish of St. George, when
they shall successively attain to the age of One and Twenty years, but
if either of them dye before he arrives the the age of One &
Twenty without lawfull issue then his said portion to be &
remain to his brother the other surviving Legatee And if both of the
said legatees should happen to dye under the age of One & Twenty
years without lawfull issue then their several legacies to be paid and
divided in equall proportions among the rest of my surviviing children;
Item I give and bequeath to my two Grand children, James and Rebecca the
children of my said son James deceased Six hundred pounds sterl that is
to say three hundred pounds Sterl each the said James to receive his
three hundred at the age of One and twenty and Rebecca to be paid her
three hundred at the age of sixteen or day of marriage But if either of
them should depart this life before they attain to their respective ages
or day of marriage, then the part or proportion of the child so dying to
be and remain to the child surviving And in case that both of them
depart this life before they shall attaine to the severall ages as
aforesaid, or day of marriage and without lawfull issue that then their
said legacyes, to be payd and equally divided among the rest of my
surviving children, all which said severall legacyes, and all other
legacyes, and annuities hereinafter mentioned are to be payed out of my
said estate in the parish of St. George; And
further it is my Will & pleasure that my two sons Peter and Joseph
have sufficient maintenance and education out of my said estate in St.
Georges untill then arrive unto their suverall ages of one and twenty
years And also that my said two Grand Children James and Rebecca be paid
to each person as shall take the care and tutorage of them, Item I give
& bequeath unto the said Rebecca and her heires for ever One Negro
Girle named Jenny and my will is that the said annuity of fifteen pounds
each shall cease and determino as soon as the said attain to their
respective ages or day of marriage as aforesaid; Item I give and
bequeath unto my Loving son Charles Pemberton all my reall estate in
land in the parish of St. John containing
thirty seven Acres with the mansion house and other the houses and out
houses thereon erected or which shall hereafter be erected on the
premises together with Tenne Substantial working slaves To Have and To
Hold (immediatly after the decease of my loving wife) to him the said
Charles Pemberton and to his heirs and assigns for ever; And also I
further give and bequeath unto my said son Charles Pemberton the sum of
Fifty pounds sterl to be paid him from my said estate in St.
George's yearly and every year during the life of my said wife; Item I
give and bequeath unto my said wife all my estate reall and personall in
the parish of St. John in full of her Dower of
both my Estates Lastly I nominate, constitute, ordain and appoint my
Dear And Loving wife Rebecca Pemberton my Son Charles Pemberton and my
Son John Pemberton Executrix and Executors of this my last Will and
Testament in wittness whereof I have hereunto put my hand & Seale
the day and year in this my Will containing one sheet and an half of
paper and is first above written

the last will & testament of the sd James Pemberton in ye presence
of us the words (of both my estates) being first interlined in ye 18th
& nineteenth lines.

Edward Fennell junr & John Tucker two of
the witnesses to the above will personally appeared before me & made
Oath on the Holy Evangelists of Almighty God that they were present
& saw the above named James Pemberton (now decd) sign, seale,
publish, and declare the same to be his last will & testament and
that at the executing thereof he was of sound & disposing mind &
memory according to the best of these deponents Judgmt and beliefe
